TERMS AND CONDITIONS
These Terms and Conditions ("Terms") govern your use of www.viedolomiti.com (the "Site") and the travel consultancy services provided by Vie Dolomiti (“we”, “our”, “us”). By accessing or using this Site, and/or making a booking, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

Definitions
Client/You – the person(s)/individual(s) making a booking through Vie Dolomiti.
Services – the travel consultancy, itinerary planning, and related services provided by Vie Dolomiti.
Booking – any confirmed request for travel services arranged by Vie Dolomiti.
Suppliers – third parties (including but not limited to accommodations, transport operators, and activity providers) who deliver goods and services booked through Vie Dolomiti.
Force Majeure – events outside our reasonable control, such as natural disasters, pandemics, government restrictions, strikes, or transport delays.

Intellectual Property
All content on this Site is the property of Vie Dolomiti and its content creators, including but not limited to text, images, logos, documents, and downloadable files. No material may be copied, reproduced, or distributed without written permission.

Scope of Services
Vie Dolomiti acts as travel consultant and intermediary, curating bespoke itineraries with third-party suppliers. We do not own or operate accommodation, transport, or activity services. Our role is to design, arrange, and facilitate travel experiences on your behalf.

Booking Terms
Free Initial Consultation
We offer one complimentary consultation to discuss your preferences, desired trip duration, budget, and travel options.
Deposit
Following the consultation, if you wish to proceed, a non-refundable deposit of AUD $1,000 is required to commence itinerary planning.
Quote
A detailed, tailored quote will be provided within 14 days of receiving your deposit. Quotes are valid for 30 days and may be subject to changes due to currency fluctuations and dynamic supplier pricing.
Final Payment
The balance of your trip cost is due upon confirmation of the quote. A binding contract is established once the deposit has been paid. Final payment confirms the booking. Failure to pay by the due date may result in cancellation. Any add-ons requested after final payment will incur additional fees.
Payment Methods & Currency
Payments are accepted via electronic funds transfer (EFT), bank transfer, or credit card. All quotes are issued in AUD unless otherwise stated. Upon request, we can also provide quotes in EUR, USD, or GBP. Please note that exchange rate fluctuations may affect final pricing.
Transparent Communication
Clients will receive timely updates regarding accommodations, activities, schedules, and transport logistics throughout the planning process.

Cancellations and Postponements
By the Client

More than 90 days before departure: Deposit only forfeited

61–90 days before departure: 60% of trip cost forfeited

31–60 days before departure: 80% of trip cost forfeited

30 days or less: 100% of trip cost forfeited
For cancellations beyond your control, a non-transferable, non-refundable credit may be issued (valid for 12 months from issue, to be used for travel within the following 12 months).
All refunds are subject to amounts actually recovered from suppliers. Vie Dolomiti is not obliged to provide refunds in excess of those amounts.
Postponement
Trips may be postponed up to 21 days before departure for uncontrollable reasons. Supplier penalties and incurred planning costs may apply. Postponements requested within 21 days are treated as cancellations.
Post-confirmation changes may incur an administration fee, and new supplier rates may apply. A name change is considered a cancellation.

Travel Insurance Requirement
Travel insurance is mandatory for all clients. It is the client’s responsibility to obtain and maintain a comprehensive policy that covers, at a minimum, medical emergencies, cancellations, delays, repatriation, and loss of belongings.
Vie Dolomiti does not provide travel insurance and is not responsible for any losses, costs, or damages incurred due to inadequate or absent insurance coverage. Clients must ensure their policy is purchased at the time of booking and remains valid for the entire duration of travel.
Vie Dolomiti reserves the right to request proof of adequate insurance coverage as a condition of final confirmation of the booking

Medical Conditions and Accessibility
Clients must disclose any medical conditions, mobility concerns, or dietary requirements prior to booking. This ensures that appropriate arrangements can be made where possible.
Vie Dolomiti reserves the right to modify or cancel itineraries if such conditions or requirements, whether disclosed or undisclosed, impact the feasibility, safety, or enjoyment of the planned travel experience.
While reasonable efforts will be made to accommodate medical or dietary requirements, Vie Dolomiti cannot guarantee that all such requests will be met by suppliers.

Client Responsibilities
Ensure valid passports, visas, and travel documents.
Comply with vaccination and health regulations.
Arrive on time for flights, transfers, and activities.
Conduct themselves respectfully towards guides, suppliers, and other travellers. Vie Dolomiti reserves the right to refuse service or terminate a booking without refund in cases of abusive, illegal, or disruptive behaviour.
Clients are liable for any damage caused to property, suppliers, or third parties during the course of travel.

Third-Party Goods and Services
Certain components of the travel arrangements, including but not limited to accommodation, transportation, dining, and activities, are provided by independent third-party suppliers (“Suppliers”). Clients acknowledge and agree that Vie Dolomiti acts solely as an intermediary in arranging such services and does not own, operate, control, or manage the Suppliers.
Vie Dolomiti makes no representations or warranties, express or implied, regarding the performance, safety, suitability, or quality of services provided by Suppliers and shall not be liable for any acts, omissions, negligence, delays, changes, loss, damage, injury, or expense caused by such Suppliers.
Clients are responsible for reviewing and complying with the terms, conditions, and privacy policies of all Suppliers, which form part of the Client’s agreement when accepting services arranged through Vie Dolomiti.

The Site may contain hyperlinks or references to external websites operated by third parties. Such links are provided for convenience only, and Vie Dolomiti does not endorse, control, or assume responsibility for the content, accuracy, policies, or practices of any third-party websites. Clients access third-party websites entirely at their own risk and remain subject to the terms and conditions and privacy policies of those third parties.

Accuracy of Information
All descriptions, itineraries, photographs, and other information provided on the Site or in marketing materials are prepared in good faith and are intended for general guidance only. While Vie Dolomiti endeavours to ensure the accuracy and reliability of such information at the time of publication, no warranty, representation, or guarantee, express or implied, is given as to its completeness, accuracy, or continued availability.
Clients acknowledge and agree that itineraries, services, facilities, or features described may be subject to change, substitution, or withdrawal without prior notice due to operational requirements of third-party suppliers, local conditions, or other circumstances beyond the control of Vie Dolomiti. Vie Dolomiti shall not be liable for any loss, cost, or inconvenience arising from typographical errors, supplier amendments, temporary unavailability, or discrepancies between published descriptions and the actual services provided.

Force Majeure
Vie Dolomiti shall not be held liable or responsible, whether in contract, tort, or otherwise, for any failure, delay, suspension, or inability to perform its obligations under these Terms where such failure or delay is caused, directly or indirectly, by an event or circumstance beyond its reasonable control (“Force Majeure Event”).
Force Majeure Events include, without limitation: natural disasters, pandemics, epidemics, public health emergencies, government actions or restrictions, war, civil unrest, strikes, labour disputes, transportation disruptions, adverse weather conditions, or the failure of third-party suppliers.
In the occurrence of a Force Majeure Event, Vie Dolomiti’s obligations shall be suspended for the duration of the event. Any refunds or remedies shall be strictly limited to amounts recoverable from third-party suppliers, less any non-refundable deposits, fees, or expenses incurred, and Vie Dolomiti shall have no further liability whatsoever arising therefrom.

Limitation of Liability
To the maximum extent permitted by law, Vie Dolomiti, its officers, employees, contractors, and agents shall not be liable to the Client or any third party for any loss, damage, cost, liability, claim, or expense of any kind (whether direct, indirect, incidental, consequential, special, exemplary, or punitive) arising out of, relating to, or in connection with the Services, the Site, or these Terms, whether based in contract, tort (including negligence), equity, statute, or otherwise.
Without limiting the generality of the foregoing, Vie Dolomiti expressly disclaims liability for:

personal injury, illness, accident, death, or property damage;

delay, inconvenience, or loss of enjoyment;

loss of, or damage to, baggage or personal belongings;

acts, omissions, or defaults of third-party suppliers; and
-
events or circumstances beyond Vie Dolomiti’s reasonable control.
In all circumstances, the total aggregate liability of Vie Dolomiti to the Client, whether in contract, tort, equity, statute, or otherwise, shall not exceed the total amount actually paid by the Client to Vie Dolomiti for the Services giving rise to the claim.
Clients acknowledge and expressly assume all inherent risks associated with travel, including but not limited to those relating to outdoor activities, cultural experiences, transportation, and the varying conditions of international destinations.

Indemnity
The Client hereby agrees to indemnify, defend, and hold harmless Vie Dolomiti, its officers, directors, employees, agents, contractors, and affiliates (collectively, the “Indemnified Parties”) from and against any and all claims, demands, causes of action, damages, liabilities, losses, costs, and expenses (including reasonable legal fees on a full indemnity basis) arising out of, relating to, or in connection with:

any breach by the Client of these Terms;

any negligent, reckless, or wilful act or omission of the Client;

any failure by the Client to comply with applicable laws, regulations, or travel requirements;

any claim made against an Indemnified Party by a third party as a result of the Client’s acts or omissions; and

any damage caused by the Client to property, suppliers, or third parties in the course of travel.
This indemnity shall survive the termination or expiration of these Terms and shall apply to the fullest extent permitted by law.

Data Protection
The Client acknowledges and agrees that the collection, storage, use, and disclosure of personal information by Vie Dolomiti shall be governed by the terms of its Privacy Policy, as amended from time to time. By entering into these Terms and utilising the Services, the Client expressly consents to Vie Dolomiti’s handling of personal information in accordance with the Privacy Policy, which forms an integral part of these Terms and is incorporated herein by reference.

Age Requirement
All bookings must be made by persons aged eighteen (18) years or older, who represent and warrant that they possess the legal capacity and authority to enter into binding agreements. Where a booking is made on behalf of additional travellers, the person making the booking represents and warrants that they are duly authorised to act on behalf of such travellers and to bind them to these Terms.

Dispute Resolution
In the event of any dispute, controversy, or claim arising out of or in connection with these Terms or the Services, the parties shall use their best endeavours to resolve the matter promptly through good faith negotiations. If the dispute cannot be resolved through negotiation within thirty (30) days, the parties agree to submit the matter to mediation before a mediator appointed by agreement of the parties, or failing such agreement, by the Resolution Institute of Australia. No party may commence legal proceedings unless and until it has first complied with the provisions of this clause, except where urgent interlocutory relief is sought.

Changes to Terms
Vie Dolomiti reserves the right to amend, vary, or replace these Terms at any time, in its sole discretion. Any material amendments will be notified to Clients by email or through publication on the Site. Continued use of the Services or the Site following such notification shall constitute deemed acceptance of the amended Terms.
The version of the Terms in effect at the time of booking shall govern that booking, unless otherwise agreed in writing.

Governing Law and Jurisdiction
These Terms, and any dispute, claim, or proceeding arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of the State of South Australia, Australia, without regard to conflict of law principles. The parties irrevocably submit to the exclusive jurisdiction of the courts of South Australia and the Commonwealth of Australia for the determination of any such dispute or claim.

Assignment
The Client may not assign, transfer, or novate any of its rights or obligations under these Terms without the prior written consent of Vie Dolomiti. Any attempted assignment in violation of this clause shall be null and void. Vie Dolomiti may assign or transfer its rights and obligations under these Terms to a successor, affiliate, or third party without restriction.

Severability
If any provision of these Terms is found to be invalid, unlawful, void, or unenforceable for any reason, such provision shall be severed to the minimum extent necessary without affecting the validity and enforceability of the remaining provisions, which shall continue in full force and effect.

Entire Agreement
These Terms, together with Vie Dolomiti’s Privacy Policy, constitute the entire agreement between the Client and Vie Dolomiti with respect to the Services and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written. No other terms, conditions, warranties, or representations shall be binding unless expressly agreed in writing by Vie Dolomiti.
